Respected Chief Justice of Pakistan,
We, the undersigned citizens of the Islamic Republic of Pakistan, respectfully submit this petition in the public interest concerning the increasing incidents of violence, harassment, abduction, domestic abuse, sexual assault, and other crimes committed against women throughout the country.
Pakistan's women and girls continue to face serious threats to their safety, dignity, and fundamental rights. Reports of rape, kidnapping, harassment, domestic violence, forced marriages, workplace abuse, cyber-harassment, and other forms of violence against women are frequently reported. Such incidents create fear and insecurity among women and their families and raise concerns regarding access to timely and effective justice.
While Pakistan possesses laws intended to protect women, many victims face obstacles in reporting crimes, pursuing legal remedies, and obtaining justice. Lengthy proceedings, social pressures, intimidation, stigma, and procedural difficulties often discourage victims from fully participating in the legal process.
CONSTITUTIONAL AND PUBLIC INTEREST CONCERNS
This petition is founded upon the constitutional principles of equality before law, protection of life and liberty, human dignity, equal protection of the law, and access to justice for all citizens.
NEED FOR SPECIALIZED WOMEN'S COURTS
We respectfully submit that there is an urgent need for dedicated Women's Courts throughout Pakistan with exclusive jurisdiction over matters involving rape and sexual assault, kidnapping and abduction of women and girls, domestic violence, harassment in public places and workplaces, cyber-harassment and online exploitation, forced marriages, honour-based violence, acid attacks, and other gender-based crimes.
PROPOSED STRUCTURE OF WOMEN'S COURTS
- Female Judicial Officers — Women's Courts should be presided over by qualified female judges possessing specialized training in dealing with gender-based crimes and victim protection.
- Female Legal and Support Staff — To create a supportive environment for victims, consideration may be given to appointing female prosecutors, female legal aid officers, female court coordinators, female counselors, and female victim-support personnel.
- Victim-Centered Proceedings — The courts should operate under procedures designed to protect victims from intimidation, humiliation, and unnecessary trauma during legal proceedings.
- Expedited Disposal of Cases — Cases involving violence against women should be heard on a priority basis to prevent prolonged delays and ensure timely justice.
- Psychological and Legal Support — Victims should have access to counseling services, legal assistance, and protection mechanisms where necessary.
- Safe Court Environment — Dedicated facilities should be established to ensure privacy, security, and dignity for women appearing before the court.
SOCIAL IMPACT
The establishment of Women's Courts would:
- Increase confidence in the justice system
- Encourage reporting of crimes against women
- Improve protection of victims and witnesses
- Reduce delays in gender-based violence cases
- Strengthen public trust in legal institutions
- Reinforce the constitutional commitment to protecting women and vulnerable members of society
A justice system that responds effectively to violence against women serves not only women but society as a whole. Ensuring accountability for offenders and providing accessible legal remedies can contribute to public safety, social stability, and respect for the rule of law.
PRAYER
In light of the foregoing, the petitioners respectfully request that the Honorable Supreme Court of Pakistan consider directing the relevant federal and provincial authorities to examine and implement appropriate measures for:
- The establishment of specialized Women's Courts across Pakistan
- The creation of dedicated judicial mechanisms for cases involving violence against women
- The appointment and training of suitably qualified female judicial and support staff
- The adoption of expedited procedures for gender-based violence cases
- The development of victim-support and protection services within the court system
- Any other measures deemed necessary to strengthen access to justice and protection for women in Pakistan
